How to use the timeshare rescission and refund calculator

The United States has no nationwide, industry-by-industry refund table for resort memberships. What you can get back is set by your purchase contract and, in the first few days after signing, by the rescission right in your state timeshare act. This tool checks that deadline first, then estimates the pro-rata value of the term you have not used.

How the numbers work - Enter the signing date and the rescission period your state statute gives you, which commonly runs from 5 to 15 calendar days. After the window closes, the calculator divides the purchase price across the contract term and subtracts the cancellation, deed-back, or transfer fee written into your agreement.

Legal basis - Timeshare rescission is state law, for example Fla. Stat. §721.10 and Cal. Bus. and Prof. Code §11238. Door-to-door and other off-premises sales may also carry the FTC Cooling-Off Rule right to cancel within three business days under 16 C.F.R. Part 429, and deceptive sales practices fall under FTC Act §5 and state UDAP statutes. Figures are current as of September 2026; rescission periods differ by state and are amended, so confirm your own statute.

This calculator is for reference only and is not legal advice. Consult a licensed attorney in your state about your specific contract.

Frequently Asked Questions

Is there a national refund schedule for resort memberships in the US?

No. Unlike some countries, the US has no federal table setting refund percentages by industry. Refunds come from your contract, from state timeshare rescission statutes, and from state consumer protection law.

What happens if I cancel inside the rescission window?

State timeshare acts generally require the developer to refund all payments made, usually within a set number of days after it receives written notice. Send the notice in writing and keep proof of mailing.

What if the rescission window has already closed?

Cancellation then depends on your contract, on any deed-back or resale program the resort offers, and on whether state unfair trade practice law applies to how the sale was made. Talk to a licensed attorney before paying an upfront exit company.
