Non-renewal notice deadline from your lease clause

When must notice of non-renewal go out?

Korea gives commercial tenants a statutory renewal right with a fixed notice window. US commercial tenants have no such right. Outside of residential rules and a few local ordinances, a commercial lease is governed by what the parties wrote, so the notice clause in your own lease is the deadline that matters. Enter the expiration date and the number of days your clause requires.

Legal basis: commercial leasing is contract law applied under each state's real property rules. Ninety, sixty and thirty day notice clauses are all common, and many leases add an evergreen clause that renews the term automatically if no one sends notice in time. Where a lease is silent and the tenant stays on, state holdover statutes supply a periodic tenancy, typically month to month with a matching notice period. Reviewed as of September 2026; read your own lease first.

Check the delivery method as well - clauses often require certified mail or a named address, and notice sent another way may not count.

Frequently Asked Questions

Do US commercial tenants have a statutory right to renew?

Generally no. Renewal rights come from the lease itself, such as an option to extend. A small number of cities have ordinances for particular commercial tenancies, but there is no general statutory renewal right comparable to Korea's.

What happens if neither side sends notice?

It depends on the lease. Many contain an automatic renewal clause that rolls the term over for a further period. If the lease is silent and the tenant remains, state holdover rules usually create a periodic tenancy on the old terms.
