How to use the adverse possession calculator

Adverse possession lets a long-term occupier acquire title to land, but only after the statutory period runs and only if every element is satisfied. Enter the date possession began, the period your state requires and any years tacked from a predecessor in privity, and the tool returns the effective start date, the completion date and the time remaining.

There is no federal adverse possession statute. Each state fixes its own period, ranging from roughly five years in California to thirty years in some eastern states, and many shorten it where the possessor holds under color of title or pays the property taxes โ€” California Code of Civil Procedure ยง325 requires tax payment for the full period, for example. The ten-year default above is a representative figure as of September 2026, so read the statute for the state where the land sits.

Time alone is never enough. Courts also require possession that is hostile, actual, open and notorious, exclusive and continuous, and land held by a government owner is normally immune. Whether these elements are met is decided by a court on the evidence, so the date here is only the earliest point a claim could mature.

Can I add a previous occupant's time to mine?

Yes, in most states, through tacking โ€” but only where there is privity between you and the earlier possessor, such as a deed, a will or an inheritance. A gap in possession or a stranger's unrelated use normally breaks the chain.

Does the period completing give me title automatically?

The claim ripens by operation of law in many states, but you will usually still need a quiet title action to obtain a recordable, marketable title that a buyer or lender will accept.
